Terms of Service

1. Agreement & Eligibility

By accessing or using any part of the Lezonder website, mobile web-app, or related services (collectively, the "Service"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. You must be at least 13 years old and legally able to enter a contract.

2. Service Overview

Lezonder motivates quality sleep by running monthly promotional sweepstakes (the "Raffle"). Users pay a recurring membership fee (Section 5) and earn tickets through qualifying sleep performance—tickets are not sold.

• Sleep-based criteria:
  • 1 ticket — Seven-day running average of ≥ 3 hours combined Deep + REM sleep.
  • 0.5 ticket — If the 1-ticket goal is not met, you may earn 0.5 ticket for going to bed before 10:30 PM local time.
• Winners & prizes: At month-end we randomly select winners proportionally to ticket counts and distribute the prize pool (80% of total membership fees).
• Free alternative means of entry ("AMOE"): To enter the Raffle without paying the membership fee, send an email to ea@lezonder.com with the subject "Lezonder AMOE" and include your full name and mailing address. One email = one ticket for that month.

3. Account Creation & Deletion

You may register with a valid email; magic-link authentication is provided by Supabase. You may delete your account at any time from within the profile settings. Deleting your account cancels future renewals but does not refund fees already charged for the current month (see Section 5).

4. User Conduct

You agree to:

• Provide accurate information and not falsify or manipulate sleep data.
• Use the Service only for lawful purposes.
• Refrain from attempting to interfere with the Service's security or integrity.

Cheating or suspected fraud (e.g., data tampering, chargebacks, abuse of AMOE) may result in ticket invalidation, account suspension, or termination at our sole discretion.

5. Payments, Renewals & Refunds

• Membership fee: USD $30, charged automatically every month until you cancel.
• Billing cycle: The initial charge occurs when you enroll; subsequent charges occur on the same calendar day each month.
• Refunds: All membership fees become part of the prize pool and are non-refundable once the monthly pool is formed (typically 24 hours after the billing date).
• Payment processor: We use a PCI-compliant third-party processor; we never store full card data.

6. Intellectual Property

All content, code, graphics, and the Lezonder name and logo are the property of Lezonder or its licensors. We grant you a non-exclusive, revocable licence to use the Service for personal, non-commercial purposes.

7. Third-Party Services

The Service integrates with third-party providers:

• Oura API (to fetch sleep metrics)
• Loops.so (to send transactional and marketing emails)
• Segment (to measure usage)

Your use of these integrations is also governed by each provider's terms and policies, which you agree to follow. Lezonder is not responsible for third-party services.

8. Disclaimers

• Data accuracy: Sleep metrics are supplied by Oura; Lezonder is not liable for inaccuracies, delays, or omissions in that data.
• No medical advice: The Service is for motivation and information only and is not medical advice. Consult a qualified professional for health matters.
• "AS IS" basis: The Service is provided without warranties of any kind, express or implied.

9. Limitation of Liability

To the fullest extent permitted by law, Lezonder (and its officers, employees, and affiliates) will not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of—or inability to use—the Service.

10. Termination & Suspension

We may suspend or terminate your account immediately if:

• you fail to pay fees when due;
• you breach these Terms, cheat, or engage in fraud; or
• we are required to do so by law.

Termination does not relieve you of obligations accrued before the effective date.

11. Governing Law & Dispute Resolution

11.1 Governing law

These Terms and any dispute are governed by the laws of the State of California, without regard to conflict-of-law rules.

11.2 Binding arbitration & class-action waiver

Any dispute that we cannot resolve informally will be resolved exclusively by binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration will take place in San Francisco County, California. You waive any right to participate in a class action.

Either party may seek injunctive relief in a court of competent jurisdiction to prevent unauthorized use or abuse of the Service or intellectual-property infringement.

12. Changes to These Terms

We may modify these Terms at any time. We will email registered users and post the revised Terms at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Miscellaneous

• Entire agreement: These Terms plus our Privacy Policy constitute the entire agreement between you and Lezonder.
• Severability: If any provision is held invalid, the remainder remains in effect.
• No waiver: Our failure to enforce any right is not a waiver of future enforcement.
