Lezonder Terms of Service

1. Agreement & Eligibility

By accessing or using any part of the Lezonder website, iOS application, or related services (collectively, the "Service"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. You must be at least 13 years old and legally able to enter a contract to use the Service. Participation in the Raffle is limited to legal residents of the United States who are 18 years of age or older (see Section 2).

2. Service Overview & Raffle Rules

Lezonder motivates quality sleep by running monthly promotional sweepstakes (the "Raffle"). Tickets are never sold — they are earned only through qualifying sleep performance.

• Sleep-based criteria:
  • 1 ticket — a day when your seven-day running average of combined Deep + REM sleep reaches approximately 3 hours.
  • 0.5 ticket — if the 1-ticket goal is not met, you may earn 0.5 ticket for going to bed between 6:00 PM and 10:30 PM local time.
  • Forgiveness rule: your single worst day each calendar month is automatically excluded from ticket calculations, so one bad night does not break your month.
• No purchase necessary — free entry: You can enter the Raffle without paying. Create a free Lezonder account, connect Apple Health or Oura, and the tickets you earn are entered into the monthly draw automatically — up to 3 tickets per month on the free plan. Free entries have the same chance per ticket as member entries. A membership does not buy tickets; it increases how many of your qualifying nights count (Section 5).
• Winners & prizes: Shortly after each month ends (normally on the 2nd day of the following month), we randomly select winners proportionally to ticket counts using cryptographically signed random numbers from RANDOM.ORG, and distribute the prize pool (80% of total membership fees for that month). Fractional ticket totals are rounded up for the draw. Winners are notified in the app and by email. Odds of winning depend on the number of tickets you hold versus the total tickets in the draw.
• Eligibility & disqualification: The Raffle is open to legal residents of the United States who are 18 years of age or older. Void where prohibited by law. We may require proof of eligibility before paying a prize and may disqualify entries that do not meet these requirements or that violate Section 4.
• Apple: Apple is not a sponsor or involved in any way with the contest or sweepstakes.

3. Account Creation & Deletion

You may register with a valid email; authentication is provided by Clerk. You may delete your account at any time from within the profile settings. Deleting your account cancels future renewals but does not by itself refund fees already charged; refund requests for App Store purchases are handled by Apple (see Section 5).

4. User Conduct

You agree to:

1. Provide accurate information and not falsify or manipulate sleep data.
2. Use the Service only for lawful purposes.
3. Refrain from attempting to interfere with the Service's security or integrity.

Cheating or suspected fraud (e.g., sleep-data tampering, refund or chargeback abuse, or abuse of the free-entry system such as operating duplicate accounts) may result in ticket invalidation, account suspension, or termination at our sole discretion.

5. Membership, Payments, Renewals & Refunds

• Membership fee: USD $30 per month, purchased as an auto-renewing subscription through Apple In-App Purchase in the iOS app and billed to your Apple ID.
• What membership does: every qualifying night counts toward the Raffle (instead of up to 3 per month on the free plan), and membership fees fund the prize pool. Membership never buys tickets directly.
• Renewals & cancellation: the subscription renews automatically each month until you cancel in your App Store subscription settings. Cancelling stops future renewals; you keep member benefits until the end of the period you have already paid for.
• Refunds: payment is processed by Apple — we never see or store your payment details. Refunds are handled exclusively by Apple under Apple's policies. If a payment is refunded or revoked, the related month's member benefits (including member-level Raffle entry for that month) end as of the refund.
• Subscription management: RevenueCat processes our subscription state (plan, renewal status, transaction identifiers) on our behalf.

6. Intellectual Property

All content, code, graphics, and the Lezonder name and logo are the property of Lezonder or its licensors. We grant you a non-exclusive, revocable licence to use the Service for personal, non-commercial purposes.

7. Third-Party Services

The Service integrates with third-party providers:

• Apple (In-App Purchase billing; Apple Health sleep data, read-only and only with your permission),
• RevenueCat (subscription management),
• Clerk (account sign-in),
• Oura API (to fetch sleep metrics, with your authorization),
• OneSignal (push notifications),
• Loops.so (to send transactional and marketing emails),
• Segment and Google Analytics 4 (to measure usage).

Your use of these integrations is also governed by each provider's terms and policies, which you agree to follow. Lezonder is not responsible for third-party services.

8. Disclaimers

• Data accuracy: Sleep metrics are supplied by Apple Health and/or Oura; Lezonder is not liable for inaccuracies, delays, or omissions in that data.
• No medical advice: The Service is for motivation and information only and is not medical advice. Consult a qualified professional for health matters.
• "AS IS" basis: The Service is provided without warranties of any kind, express or implied.

9. Limitation of Liability

To the fullest extent permitted by law, Lezonder (and its officers, employees, and affiliates) will not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of—or inability to use—the Service.

10. Termination & Suspension

We may suspend or terminate your account immediately if:

• you breach these Terms, cheat, or engage in fraud; or
• we are required to do so by law.

Termination does not relieve you of obligations accrued before the effective date.

11. Governing Law & Dispute Resolution

11.1 Governing law — These Terms and any dispute are governed by the laws of the State of California, without regard to conflict-of-law rules.

11.2 Binding arbitration & class-action waiver — Any dispute that we cannot resolve informally will be resolved exclusively by binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration will take place in San Francisco County, California. You waive any right to participate in a class action.

Either party may seek injunctive relief in a court of competent jurisdiction to prevent unauthorized use or abuse of the Service or intellectual-property infringement.

12. Changes to These Terms

We may modify these Terms at any time. We will email registered users and post the revised Terms at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Miscellaneous

• Entire agreement: These Terms plus our Privacy Policy constitute the entire agreement between you and Lezonder.
• Severability: If any provision is held invalid, the remainder remains in effect.
• No waiver: Our failure to enforce any right is not a waiver of future enforcement.
